TERMS OF SERVICE
Clear expectations for custom production. By placing an order with MK Apparel, you agree to these terms.
1. Personal Data & Communications
MK Apparel uses customer information solely to provide requested products and services, process orders, and communicate about those services. We do not sell customer data.
By providing your email address, you consent to receiving communications related to your order, services, and occasional updates. You may opt out at any time via unsubscribe links or by contacting [email protected].
We utilize third-party platforms for ordering, analytics, payments, and fulfillment (such as online store platforms and analytics tools). For a current list of partners, contact us directly.
2. Turnaround Time & Production Schedules
Standard turnaround is approximately 15 business days from final artwork approval and payment. Shipping transit time is not included.
Additional services (specialty inks, tag printing, finishing, etc.) may extend production time. Rush orders may be available for an additional fee:
- Rush (3–5 business days): +25%
- Super Rush (2 business days): +50%
MK Apparel is not responsible for delays caused by weather, power outages, supplier shortages, shipping carriers, or other events beyond our control. Customers are responsible for communicating any required “in-hands” dates at the time of order.
3. Payment Terms
- Payment in Full: Required before production begins.
- Net Terms: Available only to approved accounts. Net terms require payment via cash, check, money order, or bank transfer. Credit cards and PayPal are not accepted for net orders.
- Late Fees: Payments more than 5 days late may incur 1.5% interest per month (18% annually) plus a $30 late fee.
- Delivery Day Payment: Invoices unpaid on delivery may incur a $45 late fee and up to 14% monthly interest.
Accounts with past-due balances may be placed on hold. Returned checks incur a $30 fee. Future payments may require certified funds.
3A. Appointments & Booking Deposits
Some services may be scheduled by appointment. To reserve an appointment time, a $30 booking deposit may be required at the time of booking.
The $30 booking deposit is fully refunded upon completion of the meeting, provided the appointment is attended as scheduled. Refunds are issued to the original payment method.
No-shows or missed appointments (including appointments not canceled or rescheduled in advance) forfeit the deposit and are not eligible for a refund. Late arrivals may result in a shortened meeting or cancellation at our discretion; if the appointment cannot reasonably proceed, it may be treated as a no-show.
4. Online Stores & Chargebacks
Online store orders may be processed through third-party store platforms. Store names may appear differently on bank statements.
Disputes or chargebacks may result in:
- A $30 dispute processing fee
- Order hold until dispute resolution
- Order cancellation if disputes are not resolved
If a dispute is resolved in MK Apparel’s favor, the dispute fee may be waived. Chargebacks may delay or cancel production.
5. Quantity Allowances (Under/Over Runs)
Custom production allows a ±5% variance in final quantities. Contract orders may be calculated by impressions rather than pieces. Customers are encouraged to order extra garments when exact quantities are critical.
6. Artwork, Design & Ownership
- Customer-supplied artwork remains the customer’s property.
- Artwork created by MK Apparel remains our property unless ownership rights are purchased separately.
- Production files (separations, digitized stitch files, etc.) created for manufacturing remain the property of MK Apparel.
Artwork not supplied in print-ready format may incur preparation fees. Estimates are provided before work begins.
7. Artwork Approval & Proofing
All artwork must be approved digitally before production. One revision round is included unless otherwise stated. Additional revisions may incur fees.
Once artwork is approved, MK Apparel is not responsible for errors present in approved proofs. Changes may affect production timelines.
Colors may vary between screens and printed materials. Pantone matching is used where applicable but exact matches cannot be guaranteed.
8. Garments, Materials & Manufacturer Issues
- Garments are purchased per order and may become unavailable.
- Manufacturer defects (mislabeling, color variance, stitching issues) are not the responsibility of MK Apparel.
- Garment dissatisfaction after production is not grounds for refund.
Customer-supplied garments are accepted on a case-by-case basis and require a waiver. Refunds for defective decoration cover decoration only, not garment value.
9. Order Minimums & Setup Fees
- Screen Printing: Minimum of 6 garments per design (orders under 144 pieces may incur setup fees).
- Embroidery: Minimum of 1 piece (fees may apply).
All garments in an order use the same image size unless otherwise quoted.
10. Production Tolerances
- Placement variance up to ¾" is acceptable.
- Printing over seams, zippers, or collars may result in distortion.
- Exact ink color matching on reorders cannot be guaranteed.
Printed samples are not available.
11. Shipping, Fulfillment & Packaging
Orders ship via UPS or FedEx unless otherwise arranged. Shipping costs are not included in production timelines. Split shipping is available at current rates. Orders are bulk packaged unless otherwise requested. Customers must report issues within 48 hours of receipt.
12. Cancellations
Cancellations are subject to fees:
- Before garment order: 10%
- After garment order: 15% + return shipping
- After garment receipt: 25%
Cancellations are not accepted once production begins.
13. Guarantee
If production does not match approved artwork, MK Apparel will reprint within 10 business days. Refunds are not offered.
14. Marketing & Social Use
MK Apparel may photograph and share completed work for marketing purposes unless otherwise requested in writing before production.
15. Holidays (Non-Production Days)
Production does not occur on the following holidays:
- New Year’s Day
- Memorial Day
- Independence Day
- Labor Day
- Thanksgiving & Black Friday
- Christmas Eve
- Christmas
- Day after Christmas
- New Year’s Eve
